Tickster Pet Scan Terms of Use

Apple App Store Users (iOS)

If you obtained Tickster from the Apple App Store, your use of the App is also governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula.

In general terms, the Standard EULA:

• grants a non-transferable license to use the App on Apple-branded products that you own or control, and prohibits copying, modifying, reverse engineering, renting, or redistributing the App;
• permits the provider to collect and use technical data about your device, system, and application software in order to support and improve the App;
• remains in effect until terminated by you or the provider, and terminates automatically if you fail to comply with its terms;
• disclaims responsibility for external services, content, or materials that may be reachable from the App, and allows access to them to be limited or withdrawn;
• provides the App “as is”, without warranty, with use at your sole risk;
• limits the provider’s liability; and
• applies export restrictions and U.S. Government end-user provisions, and specifies the governing law for matters it covers.

This summary is provided for convenience only. The Standard EULA itself is the governing document, and where it conflicts with these Terms for App Store users, the Standard EULA controls for the matters it covers.

Google Play Users (Android)

Google does not publish a standard end user license agreement for developers to reference, the way Apple does. Google Play’s Terms of Service instead defer to the end user license agreement between you and the app’s provider. LexImagine is that provider, so these Terms are the end user license agreement between you and LexImagine for Android installations of Tickster. Apple’s Standard EULA does not apply to Android installations.

Your separate relationship with the store itself is governed by Google Play’s Terms of Service.

Subject to these Terms, LexImagine grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Tickster on Android phones that you own or control, for your own non-commercial use. The restrictions in “Acceptable Use” and the “Your Content And Our Content”, “Disclaimers”, “Limitation Of Liability”, “Termination”, and “Export And Legal Compliance” sections below form part of that license.

Your Account

Some features require a Tickster account. You are responsible for the accuracy of your account information, for keeping your sign-in credentials secure, and for activity that occurs under your account. You must be old enough to form a binding contract in your jurisdiction to create an account.

You can request deletion of your account or of selected Tickster data at any time. See leximagine.com/delete-account.

Subscriptions And Billing

Tickster offers Monthly and Annual auto-renewable membership plans. Both plans provide the same Tickster membership features; only the billing period and store-displayed price differ.

Subscriptions are purchased, billed, and managed through the Apple App Store or Google Play, not by LexImagine directly. Payment is charged to your store account when you confirm the purchase. Eligibility, introductory offers, current prices, renewal terms, and cancellation options are presented by Apple or Google before you confirm.

Subscriptions renew automatically unless auto-renewal is turned off before the end of the current billing period. You can manage or cancel a subscription in your Apple ID or Google Play account settings. Deleting the App by itself does not cancel a subscription.

Because LexImagine does not process these payments, refund requests are handled by Apple or Google under their applicable policies.

Acceptable Use

You agree not to:

• copy, modify, reverse engineer, decompile, or attempt to derive the source code of the App;
• rent, lease, sell, sublicense, or redistribute the App or your account access;
• use the App to violate any law, or to infringe the rights of others;
• interfere with, disrupt, overload, or attempt to gain unauthorized access to the App, our systems, or another user’s account; or
• present Tickster output as a veterinary diagnosis, or use the App to provide veterinary services to others.

Your Content And Our Content

You retain ownership of the dog profiles, notes, scan records, and optional snapshot images you create in Tickster. You grant LexImagine a limited license to store, process, and display that content solely to operate and support the App for you. How we handle this information is described in our Privacy Policy.

LexImagine and its licensors own the App, its software, design, text, graphics, and the LexImagine and Tickster names and logos. Except for the limited license granted in these Terms, no rights are transferred to you.

Disclaimers

To the maximum extent permitted by applicable law, the App and all related services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the App will be uninterrupted, timely, secure, or error-free, that scan results will be accurate or complete, or that defects will be corrected.

Limitation Of Liability

To the maximum extent permitted by applicable law, LexImagine will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of or inability to use the App, including any veterinary or animal-health outcome.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

Termination

You may stop using Tickster at any time and may request account deletion. We may suspend or terminate access if you materially breach these Terms, if required by law, or if continued provision of the App becomes impractical. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.

Export And Legal Compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws.

Governing Law

LexImagine LLC is organized in the Commonwealth of Massachusetts, United States. These Terms are governed by Massachusetts law, without regard to its conflict-of-law rules. For Apple App Store users, the governing law provisions of Apple’s Standard EULA control for the matters that agreement covers. If your local consumer laws give you rights that cannot be waived, those rights still apply to you.

Changes To These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms at this address. Material changes will be communicated where reasonably practicable. Your continued use of Tickster after the updated Terms take effect means you accept them.
